1. Introduction
These Terms & Conditions govern the use of the Shift Happens website and the purchase and participation in workshops, courses, seminars, online courses and educational services offered by Integrative Energy Kinesiology (Pty) Ltd, trading as Shift Happens – A Space for Learning (“Shift Happens”, “we”, “us” or “our”).
By using our website, submitting an enrolment form, purchasing a course or workshop, or participating in a Shift Happens educational programme, you agree to be bound by these Terms & Conditions and the policies referred to within them.
Nothing in these Terms & Conditions is intended to exclude, restrict or waive any consumer right or remedy that cannot lawfully be excluded, restricted or waived under South African law.
2. About Shift Happens
Shift Happens provides education and training in kinesiology and related complementary, holistic and personal-development approaches.
Our programmes may be delivered:
- in person;
- online;
- through Teachable;
- through Zoom or similar platforms;
- through a combination of online and in-person learning; or
- through other educational formats.
3. Definitions
For purposes of these Terms:
“Company” means Integrative Energy Kinesiology (Pty) Ltd.
“Shift Happens” means Integrative Energy Kinesiology (Pty) Ltd trading as Shift Happens – A Space for Learning.
“Student” means any person who enrols in, purchases, attends or participates in a Shift Happens course, workshop or educational programme.
“Workshop” means an in-person or online educational workshop, seminar, training programme or similar event.
“Online Course” means an educational programme delivered through Teachable or another online learning platform.
“Enrolment Form” means the form completed by a prospective student to request participation in a workshop or course.
“Deposit” or “Initial Payment” means the amount specified for the particular workshop or course at the time of enrolment.
“Full Payment” means payment of the complete advertised course or workshop fee.
“Payment Plan” means an agreed arrangement to pay the applicable fee in two or three instalments, where that option is offered.
“Manual” means any printed or digital educational manual, workbook or course resource supplied as part of a programme.
4. Enrolment and Booking Confirmation
Completion and submission of an enrolment form indicates your intention to enrol in the relevant workshop or course.
An enrolment is considered confirmed once the enrolment form has been completed and submitted together with either:
- the specified deposit/initial payment; or
- full payment,
as applicable to the particular workshop or course.
The applicable payment requirement will be clearly communicated for the relevant programme.
An enrolment form submitted without the required payment does not necessarily guarantee a place.
5. Why We Require Payment at Enrolment
Workshop numbers may determine whether a workshop can proceed.
This is particularly important where Shift Happens is engaging international instructors, booking venues, arranging travel or making other commitments based on confirmed student numbers.
For this reason, Shift Happens may require the deposit or initial payment at the time of enrolment.
Once the required payment has been received, the booking becomes subject to the applicable Refund & Cancellation Policy and any workshop-specific terms.
6. Payment Options
Depending on the particular workshop or course, Shift Happens may offer:
Option 1 – Payment in Full
The complete course or workshop fee is paid at the time of enrolment.
Option 2 – Two Instalments
The total fee is divided into two agreed payments.
Option 3 – Three Instalments
The total fee is divided into three agreed payments.
Not every workshop will necessarily offer all three options.
The available payment options, amounts and payment dates will be communicated for the particular programme.
7. PayFast
Shift Happens intends to use PayFast as an online payment service.
Payments made through PayFast are subject to the applicable PayFast payment process and terms.
Shift Happens does not intend to collect or store complete credit or debit card details.
8. Payment Plans
Where an instalment arrangement is selected:
- each instalment remains payable by its specified due date;
- access to a course or workshop may be subject to payment being up to date;
- failure to make an instalment payment may result in suspension of access or participation;
- outstanding balances remain payable unless otherwise agreed in writing; and
- cancellation and refund arrangements remain subject to the applicable Refund & Cancellation Policy.
9. Workshop-Specific Payment and Cancellation Terms
Because the financial commitments associated with workshops differ, each workshop may have its own deposit, initial payment, payment schedule and cancellation/refund terms.
This is particularly relevant to workshops involving international instructors.
The applicable terms displayed at the time of enrolment will form part of the agreement between Shift Happens and the student.
10. Refunds and Cancellations
Refunds and cancellations are governed by the Shift Happens Refund & Cancellation Policy.
The specific refund applicable to a workshop may depend upon:
- the amount paid;
- the time remaining before the workshop;
- whether an international instructor is involved;
- non-refundable commitments already made;
- venue and travel commitments;
- whether a replacement participant is found; and
- the specific terms published for that workshop.
The applicable workshop-specific cancellation terms will be communicated before or at the time of enrolment.
11. Repeat Students
Students who repeat the same workshop with Shift Happens within five years of their original attendance may receive a:
50% reduction on the workshop cost.
This repeat-student rate:
- applies to the workshop fee;
- does not include a new manual;
- is subject to confirmation of the student’s previous attendance; and
- may be subject to the specific arrangements applicable to the workshop.
If a repeat student requires a new manual, the manual will be charged separately at the applicable rate.
12. Workshop Dates and Venues
Workshop dates, venues and schedules will be communicated at the time of booking.
Dates and venues may occasionally change because of circumstances such as:
- instructor availability;
- venue availability;
- travel requirements;
- operational considerations; or
- circumstances beyond our reasonable control.
Where a material change occurs, we will communicate with affected students as soon as reasonably practicable.
13. International Instructors
Where an international instructor is involved, Shift Happens may incur significant non-refundable commitments before the workshop takes place.
For this reason, the cancellation and refund terms for such workshops may differ from other workshops.
The specific terms applicable to the workshop will be clearly communicated before enrolment.
14. Online Courses
Some Shift Happens courses are delivered online through Teachable or another learning platform.
Online course access is personal to the enrolled student.
Students may not:
- share login details;
- transfer access to another person without permission;
- reproduce course content;
- record course videos;
- redistribute course material; or
- make the course available to unauthorised persons.
15. Educational Nature of Our Services
Shift Happens provides educational and training services.
Our programmes may cover kinesiology, anatomy and physiology, complementary approaches, holistic models, energy-based frameworks, meridian systems, emotional concepts and related subjects.
The inclusion of a particular theory or approach does not necessarily mean that Shift Happens represents it as medically established or clinically proven.
16. Medical and Healthcare Disclaimer
Shift Happens does not advertise its educational services as providing medical diagnosis, medical treatment or medical cures.
Our educational content is not intended to replace appropriate medical or healthcare advice.
Students are responsible for understanding their own qualifications, professional scope and legal obligations.
17. Qualifications and Certification
Completion of a Shift Happens course or workshop confirms completion of the relevant educational requirements.
A Shift Happens certificate does not automatically:
- confer a government-recognised healthcare qualification;
- confer professional registration;
- authorise diagnosis or treatment of medical conditions; or
- authorise a person to use a professional title they are not otherwise entitled to use.
Students remain responsible for complying with applicable professional and legal requirements.
18. Student Code of Conduct
All students are expected to comply with the Shift Happens Student Code of Conduct.
This includes requirements relating to:
- respect;
- appropriate communication;
- consent;
- physical boundaries;
- confidentiality;
- harassment;
- bullying;
- discrimination;
- intellectual property;
- academic integrity;
- professional conduct; and
- online behaviour.
Serious breaches may result in removal from a workshop or suspension/termination of course access.
19. Positive Learning Environment
Shift Happens is committed to providing a learning environment in which students feel:

We welcome respectful differences of opinion and encourage curiosity, discussion and constructive questioning.
20. Intellectual Property
Shift Happens’ original educational material is protected by applicable intellectual property and copyright law.
Students receive a limited right to use course materials for their own educational purposes.
Purchasing a course does not transfer ownership of the underlying intellectual property.
Students may use the knowledge they learn in their own lawful practice but may not copy Shift Happens’ original manuals, worksheets, diagrams, presentations or substantial course material and present it as their own.
21. Third-Party Intellectual Property
Not all workshops offered by Shift Happens are necessarily owned by Integrative Energy Kinesiology (Pty) Ltd.
Shift Happens may be authorised, licensed or otherwise permitted to teach programmes developed by third-party instructors, organisations or copyright holders.
Where applicable, the underlying intellectual property remains with the relevant copyright holder.
Students must respect all applicable licensing and copyright restrictions.
22. Privacy
Personal information will be processed in accordance with our Privacy Policy and applicable South African privacy legislation, including POPIA.

23. Cookies
Our website uses cookies and similar technologies.
Our current website technology includes:
- Google Analytics;
- Meta Pixel; and
- other technologies to be confirmed by the website team before publication.

The information provided on the Shift Happens website is for general educational and informational purposes.
It is not medical advice and should not be relied upon as a substitute for consultation with an appropriately qualified healthcare professional.

Students and customers may raise complaints in accordance with our Complaints Procedure.
We aim to handle complaints:
- fairly;
- respectfully;
- objectively;
- confidentially where reasonably possible; and
- without unnecessary delay.
26. Third-Party Links and Services
Our website may contain links to or use services provided by third parties.
These may include:
- PayFast;
- Teachable;
- Google;
- Meta;
- website hosting providers; and
- other technology providers.
Third-party services are subject to their own terms and policies.
27. Website Content
We make reasonable efforts to keep our website accurate and current.
However, information may occasionally change or contain inadvertent errors.
We reserve the right to update:
- course descriptions;
- dates;
- venues;
- prices;
- instructors;
- schedules; and
- other website information.
28. Liability
Nothing in these Terms & Conditions is intended to exclude or limit liability that cannot lawfully be excluded or limited under South African law.
Subject to that limitation, Shift Happens will not be responsible for losses arising from circumstances outside our reasonable control or from a person’s misuse of educational information.
29. Force Majeure
Shift Happens will not be responsible for delays or inability to provide a workshop or course caused by circumstances beyond our reasonable control.
These may include:
- natural disasters;
- serious illness;
- government restrictions;
- travel disruption;
- venue closure;
- instructor emergency;
- technological failure;
- civil unrest; or
- other unforeseen circumstances.
Where this occurs, we will seek a reasonable solution.
30. Changes to Terms
We may update these Terms & Conditions from time to time.
The latest version will be published on our website.
Where a change materially affects an existing booking, we will communicate with affected students where reasonably appropriate.
31. South African Law
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Nothing in these Terms is intended to deprive a consumer of a right or remedy that cannot legally be excluded.
The CPA establishes national standards for consumer protection and prohibits various unfair and misleading business practices. (Government of South Africa)
