Copyright and Intellectual Property Policy

1. Purpose

Shift Happens protects its original educational content and respects the intellectual property of instructors, organisations and other copyright holders.

South African copyright is principally governed by the Copyright Act 98 of 1978, as amended. (Government of South Africa)


2. Shift Happens Intellectual Property

Unless otherwise stated, original material created by or for Shift Happens may include:

  • manuals;
  • workbooks;
  • presentations;
  • diagrams;
  • worksheets;
  • videos;
  • recordings;
  • graphics;
  • website content;
  • templates;
  • assessments;
  • course structures; and
  • original educational resources.

3. Personal Learning Licence

Students may use supplied materials for their own educational purposes.

They may not reproduce or commercially exploit those materials without permission.


4. Knowledge Versus Material

Students are free to use the knowledge and skills they learn in their own lawful practice.

They may not copy Shift Happens’ original expression of that knowledge.

For example:

Learning a technique and using it in your own practice — permitted.

Copying the Shift Happens manual and teaching it as your own course — not permitted.


5. Manuals

Students may retain and use their manuals for personal learning.

They may not:

  • reproduce;
  • scan;
  • distribute;
  • sell;
  • upload; or
  • commercially exploit

the manual without permission.


6. Repeat Students

Students repeating a workshop within five years receive the applicable 50% repeat-student workshop reduction.

This does not include a new manual.

A new manual is charged separately.


7. Online Courses

Students may not:

  • share login details;
  • record videos;
  • distribute course content;
  • upload material;
  • sell access; or
  • provide unauthorised access.

8. Teaching

Completion of a Shift Happens workshop does not automatically authorise someone to teach that workshop.

Students may create their own courses using their own knowledge and experience, provided they do not reproduce Shift Happens’ protected material.


9. Third-Party Programmes

Not all workshops offered by Shift Happens are necessarily owned by Shift Happens.

Shift Happens may teach certain programmes under licence, authorisation or other permission.

The underlying intellectual property remains with the relevant copyright holder where applicable.


10. Branding

Students may not use:

  • Shift Happens branding;
  • logos;
  • course names; or
  • other branding

in a way that implies they are an authorised representative or instructor unless permission has been granted.


11. Recording

Students may not record workshops, lectures or online sessions without permission.


12. Copyright Infringement

Suspected infringement may be reported to:

Shift Happens may take appropriate action against unauthorised copying or distribution.

13. Permitted Acts

Nothing in this policy is intended to prevent a person exercising a right legally permitted under applicable copyright law.
